Welcome to Devine Custom Apparel LLC (“Company,” “we,” “our,” or “us”). By accessing our website or purchasing from us, you agree to the following Terms & Conditions.

1. Use of Our Website

By using our website, you confirm that:

  • You will provide accurate and complete information
  • You will not use our website for unlawful purposes

We reserve the right to refuse service to anyone for any reason at any time.

2. Custom Orders

Devine Custom Apparel LLC specializes in custom apparel and custom tumblers, including vinyl and DTG printed products.

By placing a custom order:

  • You confirm you have the legal right to use any logos, images, or artwork submitted.
  • You accept responsibility for any copyright or trademark violations related to your submitted files.
  • You understand that colors may vary slightly due to screen settings and printing processes.

SUPPLIED GARMENT POLICY

· The customer's garments (or other articles) are accepted on the strict understanding that Devine Custom Apparel will not accept any liability whatsoever for any misprints, stains, and damage to the customer supplied garments. Devine Custom Apparel printing process and other decorating techniques, such as vinyl or DTG printing, involves high heat and other treatments that may impact the quality of the decoration and the item to be decorated. In addition, there is some risk that printer and human error will occur.

· If you supply the garment (or other articles) and there is a problem, we do not replace your item nor reimburse you for the item's value. Your damaged piece will be returned to you with an apology. Therefore, we prefer to work on garments from our suppliers that Devine Custom Apparel knows will work for your needs and may be easily replaced should a production error occur. We do not replace or reimburse customer-owned garments that fade after being washed. When presenting your own garments for decoration, you will be required to sign a waiver indicating your acceptance of these terms before we will decorate them.

We reserve the right to refuse designs that are offensive, unlawful, or infringe on intellectual property rights.

3. Pricing & Payments

All prices are listed in U.S. dollars.

We reserve the right to modify prices at any time without notice.

Payments are securely processed through PayPal. We do not store full credit card information.

Orders will not begin production until payment is successfully received.

4. Order Approval

For custom items requiring mockups:

  • Customers are responsible for reviewing and approving designs before production.
  • Once approved, we are not responsible for spelling errors, sizing issues, or design placement mistakes that were approved.

5. Production Time

Production times vary depending on order size and complexity. Estimated timeframes are not guaranteed and may vary during peak seasons.

6. Limitation of Liability

Devine Custom Apparel LLC is not liable for:

  • Indirect or incidental damages
  • Delays caused by shipping carriers
  • Customer errors in submitted artwork

7. Governing Law

These Terms are governed by the laws of the State of Florida.

ADDITION TO TERMS & CONDITIONS

Rush Orders

Devine Custom Apparel LLC offers rush production services when availability permits.

  • Rush orders must be approved by us before payment.
  • A non-refundable rush fee will apply.
  • Rush production shortens processing time only — it does not guarantee carrier delivery speed unless expedited shipping is also selected at checkout.
  • Once a rush order is confirmed and payment is made, it cannot be canceled or modified.

We reserve the right to decline rush requests during peak seasons or high-volume periods.

ADDITION TO TERMS & CONDITIONS

Chargebacks & Payment Disputes

Devine Custom Apparel LLC works hard to resolve any concerns directly with our customers.

By placing an order, you agree to contact us first to resolve any issue before filing a chargeback or dispute through PayPal.

Because our products are custom-made:

  • Filing a chargeback for a properly fulfilled custom order may be considered a violation of these Terms.
  • We reserve the right to submit proof of design approval, production records, shipping confirmation, and delivery tracking in response to any dispute.
  • Customers who file fraudulent chargebacks may be refused future service.

We are committed to fair resolutions and encourage open communication before disputes are escalated.

Copyright & Trademark Policy

Customers are responsible for ensuring they have legal rights or permission to use any logos, images, phrases, or artwork submitted for custom printing.

By submitting artwork, you confirm that:

  • You own the rights to the design, OR
  • You have written permission from the copyright or trademark owner.

Devine Custom Apparel LLC is not liable for copyright or trademark infringement resulting from customer-submitted files.

We reserve the right to refuse any design that:

  • Appears to infringe on intellectual property rights
  • Contains copyrighted brand logos without authorization
  • Is unlawful, offensive, or inappropriate

Bulk & Group Orders

For bulk or group orders (large quantities for schools, businesses, churches, events, etc.):

  • A deposit may be required before production begins.
  • Bulk orders may require additional production time.
  • Final quantities must be confirmed before production.

Once bulk production begins:

  • Changes to sizes, colors, or designs cannot be made.
  • Deposits are non-refundable.

We strongly encourage customers to carefully review mockups, sizing charts, and order details before approval.
